Tal iniciativa,defendida y apoyada en parte por Justice Fellowship, obtuvo fondos de la legislatura de Indiana a fin de crear programas de servicio comunitario como alternativa viable al encarcelamiento en el Estado (Van Ness, 1986 en 194).
Los legisladores consideraron que el programa podría ser una oportunidad para solucionar el problema de la superpoblación carcelaria en el Estado. Delincuentes no violentos, que deotro modo hubieran sido encarcelados, recibieron la posibilidad de realizar servicios comunitarios o hacer una reparación a sus víctimas en lugar del encarcelamiento. El interés acerca del programa original aumento de tal modo que el presupuesto destinado a programas de servicio comunitario fue incrementado de sólo $250.000 en 1980 a $6 millones de dólares para 1985.
En el Reino Unido, elParlamento promulgó, a principios de los 70, leyes que otorgaban a los tribunales facultades específicas a fin de poder ordenar el servicio comunitario como condena, y no sólo como condición para la libertad condicional (Wright, 1991 en 40). El servicio comunitario creció como parte del sistema de libertad condicional; y a los funcionarios de libertad condicional se les delegaba la exclusivaresponsabilidad de asegurar el apoyo para los programas de servicio comunitario, además de organizarlos. A medida que estos programas ganaron el apoyo público, algunos especularon acerca de si el elemento reparador era el que lograba dicha atracción.
El servicio comunitario esta recién empezando a propagarse en toda Latinoamérica, prueba de ello es Argentina en la década de los 80, Uruguay en el 2002,Venezuela en el 2005 entre otro, de igual manera existen países considerados expertos en el área del servicio comunitario, como lo son México en 1910 y Costa Rica 1975.En el caso de Argentina, el servicio comunitario o aprendizaje-servicio con es llamado allí, surgió luego de la recuperación de su democracia a principios de los 80’, al plantearse proyectos sociales para mejorar su situacióneconómico-social. Un hecho resaltante en la historia del servicio comunitario en Argentina es que los pioneros fueron las escuelas y no las universidades, pues los maestro notaron que los alumnos se motivaban mucho más cuando vinculaban proyectos de servicio con los contenidos de estudio; fue entonces en el año 1986 cuando una de sus provincias establece “Proyecto de Servicio” como una materia...
