Thanks for doing this. We are facing mediation soon with our landlords who illegally withheld our deposits, illegally removed our property, and changed the locks on our unit when we were still tenants and had paid the full month's rent. This helps give us an idea of what to expect.
This was waaaaaaaaayyyyy more civilized than when I took MY landlord to mediation. My landlord screamed and argued with our mediator. She lied like crazy, too, even when she was proven wrong. When I sat outside during her caucus, you could hear her through the door, and you could hear the mediator telling her to calm her ass down, lol. and so did everyone else who was waiting for their case. As for me, I barely had to say a word.
Hello folks, I'm currently undergoing training for mediation, and I would like to say that this was a very helpful resource to me, as I picked up a few things after watching this mediation. However, I would like to respectfully give a few points as to what I realized while watching this mediation, and what I would do or change given my style of mediation. Hopefully this could give you a different perspective on the mediation process. As most of us know, this was a mock mediation, and only serves to give people a glimpse of what a tenant-landlord situation would look like. As far as I know, a normal mediation would rarely take this little time, and could potentially be more volatile emotion-wise. Throughout the mediation, I enjoyed watching the mediator take a more passive but firm approach when talking to the landlord and tenant. But is it me, or was caucus called way too early?? I could see calling caucus early as an effective strategy to gain knowledge of the situation early without interference of the other party, but I wasn't entirely sure if it was necessary. It almost seemed as if both parties weren't able to fully explain their stories. Another thing I noticed was that the mediator rarely used reframing to clarify what was being said by both sides, but I suppose the matter was extremely clear to both the tenant and the landlord. These participants are most likely much much MUCH more experienced that I am, but one thing I noticed was that the mediator seemed to become less and less impartial as the video went on. You can notice the mediator remind the tenant frequently about potential repercussions and the chance of being evicted if he did not come to an agreement. And finally, when terms of the agreement were discussed, the mediator once again reminded the tenant of the consequences. All in all, they did a much better job than I would have ever dreamed of doing, but thankfully I am going to another training session to roleplay these exact kinds of situations! It's amazing how such an old video can still serve to be an amazing tool for mediators in training just like me.
@Autumn Echo No prob! I'm glad to hear that you're currently learning about conflict resolution. It's actually pretty crazy that I'm re-visiting this video from a whole year ago, and it reminds me of when I first wanted to learn about mediation. However, life kinda changed for me, and I decided to study psychology at my university. Mediation/conflict resolution was definitely my second career choice, but I'm glad that I'll be able to help people in a similar capacity as a psychologist. Looking back in hindsight, I can say that mediation was one of the most enjoyable skills to pursue. As for you, keep at it! It'll be totally worth it :)
I just wanted to thank you for your review. I am taking an online conflict resolution class and have a mediation assignment on this video. Your review helped me to look back and really watch what happened in the video which helped me to answer some of the questions on the assignment. So thank you for your input!
I think Dennis got tired of working. He took his extended vacation and figured it would work out in his favor. He forgot to pay his rent!! Then he found out Linda wasn't messing around!!! She rightfully wanted her rent from him.
I lost a job of four years and became late with my rent. I skipped any meetings with the landlord. I just packed and left not waiting for an eviction. Later,I was able to rent another apartment in a prestigious area. At a higher security deposit, but still... All this is to scare you and make you pay. But I wouldn't dare to stay anywhere for free and fight for any rights. The landlord is right. This is business, not charity. Btw, shelter is offered to you immediately if you have no income. Just dial 211.(NJ)
I like this video, I do have some suggestions. Sit both parties on the same side of the table. Have the parties find their own solutions, and have them feel like they came to the solution theirselves. Always caucus with the tenant first. Advocate for both parties. Do not put someone in the “hot seat”. Listen.
Most mediators are not Lawyers but, get lawyers fees. They take a 10 week course. I almost lost my mind when I found out. Be very careful. Anyone cane be a Mediator. PAY ATTENTION
Entertaining--because it's so real. Genuine conflict, and not the kind of thing one sees on television. I don't know that it is "scripted:" seems too genuine. And maybe both gave permission to put it on KZclip...after the fact.
It just shows how the house market destroys people’s minds ! He’s a sir without job she is a business person ... Government knows that house is a big issue !
Great educational video. Wrong dispute material. Never heard a landlord mediate with a delinquent tenant. They simply evict them and sue for any unpaid rent and that’s that.
As a tenant rent is essential to be paid. Make payment arrangements BEFORE you get into difficulty. I can see both sides. The tenant is not being reasonable to be honest. You can't expect to stay for free and then complain when the Landlord gets upset about wanting their money. You go without cable TV and use pre-pay phone service. It can be done.
Homelessness creates debts for city and States, and when the the local City Police Commissioners don't agree to let the United States people to work because they don't like them or not able to control those United States citizens lives, homeless will increase and continue. The the States City police Commissioners are a problem for the United States government, because the landlords are right to want their rent on time or in a few days.
I was a bit nervous but all set to mediate my fist "case". When each party arrived, the first thing each one did is roll out a mat then sit on it cross-legged; Turns out they thought this was to be a meditation session.... HAHA, I know, stupid joke- Seriously, this video was great!
Apparently, the mediator is biased and she is also threatening the tenant with eviction. She can see that the tenant is in a fix. I enjoyed watching though as I handle quite a lot of landlord/ tenant issues.
She's merely pointing out he's broken the rental contract terms by not paying rent, so legally, his Landlord can evict him. The mediator has no power to evict him that is the Landlords decision: which she can make, legally, because he's broken the terns if his rental contract by not paying . The mediator is doing her Court appointed role, pointing out where the situation is at legally & trying to find a solution for both of them .
Good to see a hard core landlord. So many renters play the system with court ordered stays and delays to a point they don't pay the rent for more than a year. Many renters are clever when it comes to utilizing renter rights and motions to stifle an eviction.
@Carguy Yet businesses do work that way. You can’t go into a car lot with a 400 credit score and lease a Lamborghini. Why? Because you don’t have the credit or the finances to pay for it. The same goes for house owners. If you cannot afford it without someone else paying you, you don’t need an extra house. They’re not a victim, they’re just irresponsible owners
@👿Furby Gender 🥱dont blame the victim. Do you say the same thing to your car finance company? Nope. They repossess the car. A landlord doesn’t owe you housing. It’s not someone else’s job to house you. Wether or not a landlord can’t afford’ anything has nothing to do with the contract you signed to pay. The landlord’s financial situation has nothing to do with the fact that you you need to pay rent. NOTHING. Ps- the only irresponsible one is the tenant stealing from the landlord living off someone else’s back
Linda is foul Dennis definitely needed to figure out a way to pay his rent in some way but she seemed to have something against him for someone who's been loyal for 4+ years "I just want him out and want my money". the only reasons she changed her mind is because Terry told him without an agreement you'll be looking to find something for awhile.. " screw up his record I don't care ... we were friends once" lol this was really entertaining though
Hello folks! Find the Right Attorney for Your Case Can Seem Impossible. If you or somebody you care about has been wronged by your employer, you may need assistance from a skilled attorney today. At the Marcarian Law Firm, we are standing by to help ensure that workers in and around the Los Angeles area receive any compensation they are entitled to after experiencing the situations.
This guy needs government shelter. Renting is a business if you don’t pay you leave the house. Before you rent save money at least for 6 month coverage.
Landlords are always concerned about their investment especially retired landlords who depend on their investment income to survive. You see, it's all about everyone doing their honest part and doing what's right to each other. If we all loved our neighbors as ourselves there would be no need for courts, police, lawyers, politicians, guns, laws, wars, security systems and whatever else we would need to prevent each other from harming each other.
There's are resources out there that can help you when times get tough. Alot of people don't know about these resources. He should give money to the landlord out of each check. Shows your trying to show good faith.
I see a lot of support for the landlord. Imagine being the tenant and losing your job. The first thing that goes into your mind is how your going to pay your rent. Your already hurting losing that job and now your going to be homeless? Coming back from losing the job is gonna be difficult. You feel too far gone when your homeless on top. This is a situation where I'm saying that this tenant never had problems before and always been responsible.
@Pit Bull in California, where I am, you don't want that tenant. We're limited to rent increases at 5% plus inflation or 10% which ever is less, why would I keep the tenant who's (Not) paying rent capped at $1700 a month when I can get rid of him and rent it out to somebody who can and will pay $2800-$3,000 a month. In my mind he's already stealing the difference between the $1700 month rental rate and market rate of $3000 each and every month, now he's stealing the rest of it too.
@OceanLover Well, If one has always been a good tenant, always paid your rent on time, kept the place clean, and quiet, most of the time it's worth keeping that tenant. You know this tenant and your more likely to get all your money back as soon as they get back on their feet. Setting aside emergency money is always necessary and responsible. If the tenant is a good person they are aware of their limits. If they don't see the light at the end of the tunnel within reason, they'll vacate. You don't need to steal money from me, If have it to give...I will. But if your that type of person that always has their hand out...
Imagine having someone steal thousands of dollars from you every single month and expecting you to be cool with it because they don't have a job. How about when I lose my job I hit you up for a thousand each month?
I was almost laughing when he said he had no place to go ! In the town I live in homeless people are put up in hotels and motels within 24 hours until they get into apartments . It's called rapid rehousing .
This is Arbitration and not Mediation. In a real meditation the mediator do not take a side nor "push" or threat one side especially when both sides are in the room.
She did not do any pushing or threatening of either side. She did not even tell the tenant that the law says he MUST pay or move and that the landlord has legal right to charge both late fees and double damages (& damages amounts vary from state to state-treble damages are allowed in CA). In my opinion, she did an excellent job of mediation (except for maybe she should set the tenant straight about the accuracy of the law info given because he had an entitled attitude). He was entitled and the landlady came off as mean, but then again she was obviously frustrated because the tenant was VERY far behind in his rent already!
Line up another place to live..settle all the details..then split on your own, furtively. That way no eviction is stated, the money from jewelry goes to the new place. And voila! Onward.
As a landlord myself, I totally sympathise with this woman, and my advice would be to evict as soon as possible, even it means foregoing the rent you're owed. It'll cost you far more if you give in.
Landlord- "I want to get that money! I'm not a charity. He deserves to have a eviction on his record." And on and on. What a vicious, money hungry, vindictive woman.
Renting shouldn't be a business, as housing is a necessity. I'm not saying don't pay rent or things like that, but the problem is that renting is considered a business, and landlords take advantage from this. In London, U.K., there are very few landlords who really "take care" of their business, such as fixing what needs to be fixed for a decent living, etc... If landlords want to treat renting as a business, then fix the shit that needs to be fixed. I'm saying they take advantage of this because they know that if they don't fix the stuff that gets damaged in time, and if the current tenants decide to leave the property, they will always have someone who will rent their place, as housing is a necessity. Also, how can you even compare it to a business when there are things to take into account such as problems that tenants can go through in their lives? I'm not saying being uncommunicative, but this system needs to go sometimes out of the long paragraphs from tenancy agreements to considerate personal cases. I'm a tenant in a situation where we were all evicted from our property because of a problematic and dangerous tenant, as we were all in a joint agreement. We have all moved out from the current property except for this problematic and dangerous tenant, and the agency and landlord wants money from us as they said “we’re all liable for the rent”, which is what the contract says. But in cases like this, there should be a way to solve this outside of the contract, as we cannot control this person. Not even the police can help. It’s the most stupid thing I’ve ever come across to. I know they want their money, but what can we do about it? We people who can’t afford paying double rent, but it seems that the law is still on the landlord’s side. We cannot even afford a solicitor. That’s why we pay rent, because we do not have saved money for a mortgage yet. And yet, we are only able to get a place through rent when at the end the money we’re paying in rent would be the same money we would be paying for a place that is ours. We tenants are paying landlords’ mortgages, which is unfair. Renting a place should be less than when you’ve bought a place. The scheme is the same as rent to buy anyway.
Landlord is too lenient - Landlord has a mortgage payment, and other fees, which Landlord is not allowed to skip payments - Tenant should and must be responsible with due dates and abide to the contract- Tenant already breached contract
You have to have the patience of God to listen to adults bickering for 20 mins. There’s absolutely no way she makes enough money to do this. Linda needs a Xanax, she came into this way too high strung and btw he could reverse it on you, how is it his fault you can’t afford your property without someone paying you? You’re not a business, you’re equally irresponsible for going in debt for properties you can’t afford. You don’t care if his record is screwed up and because you’re vindictive, you want him to be homeless by having an eviction on his record? That will backfire on you guaranteed.
Two points the landlord did not ask: a) I want a professional appraiser to verify the value of mentioned jewelry. If jewelry is not valued at $3,000 or more, I the landlord may evict tenant on the date of appraisal. b) March rent to be paid on the first of the month. How can you (tenant) guarantee me March’s rent will be paid on time? Feeling bad for the man but he must have a combination of social security and unemployment coming in, enough to cover the rent. And then I feel bad for the landlord. The tenant has been and still is disrespectful and non communicative to the landlord. If someone owes you money and they deliberately avoid you, wouldn’t you be upset and tough on them? Seriously, society pushes the victim mentality too far especially when it is underserving.
omg the logic “no one’s gonna move in the winter so she’s gonna have an vacant apartment anyways so i might as well live for free”. well dude, people don’t only move when it’s convenient…. for example when you get kicked out and have to find another place you will be moving in somewhere in the winter…. doesn’t he get social security or have family or anything
Even though they’re actors, I’d be damned if my landlord is gonna increase the amount I owe by two/three-fold bc I’d just laugh in her face. Nowhere is that acceptable for being 5 weeks late on rent like wtf 👋🏼😂
The tactics of renting houses and show the houses to 20 candidates at same time and most the times tenant still there with furniture so people cannot see the state of house .
This isnt even be a discussion. It’s not the owners problem if he can’t pay. Evict and move on. Dumb of her to entertain the idea letting him continue.
The party that brought case to mediation, sometimes when court judge sends cases to mediation, he can decide if fees should be split or even waived. Some courts request that mediator work at least one case free of charge.
Thanks for doing this. We are facing mediation soon with our landlords who illegally withheld our deposits, illegally removed our property, and changed the locks on our unit when we were still tenants and had paid the full month's rent. This helps give us an idea of what to expect.
That's all criminal what landlords
This was waaaaaaaaayyyyy more civilized than when I took MY landlord to mediation. My landlord screamed and argued with our mediator. She lied like crazy, too, even when she was proven wrong. When I sat outside during her caucus, you could hear her through the door, and you could hear the mediator telling her to calm her ass down, lol. and so did everyone else who was waiting for their case. As for me, I barely had to say a word.
I hope this is about someone else. Let’s NOT go there with all my stolen money
These landlord lies so much
Then move
So what happened? Did you get paid? I'm going through it and need to hear something good?
As a Florida Certified County Court mediator, I enjoyed watching this. I volunteer twice a month to mediate small claims cases.
what's in it for you to mediate if there's no monetary compensation. How do you "get paid"
I want to get started. Where did you take your certification?
Hello folks,
I'm currently undergoing training for mediation, and I would like to say that this was a very helpful resource to me, as I picked up a few things after watching this mediation.
Oliver Jung have u completed your training?
@Autumn Echo No prob! I'm glad to hear that you're currently learning about conflict resolution. It's actually pretty crazy that I'm re-visiting this video from a whole year ago, and it reminds me of when I first wanted to learn about mediation. However, life kinda changed for me, and I decided to study psychology at my university. I just wanted to thank you for your review. I am taking an online conflict resolution class and have a mediation assignment on this video. Your review helped me to look back and really watch what happened in the video which helped me to answer some of the questions on the assignment. So thank you for your input!
8:25 “I would rather be in her shoes coz I don’t have a job” 🤣 he killed so funny
i found the mediator focused, fair, and powerful
Always keep a calculator handy during mediation. Great showcase of skill, movement, and appropriate reframing.
I think Dennis got tired of working. He took his extended vacation and figured it would work out in his favor. He forgot to pay his rent!! Then he found out Linda wasn't messing around!!! She rightfully wanted her rent from him.
The landlord wouldn't necessarily get an eviction if he missed a payment, that would still need to be secured through a court proceeding.
watching this for my mock mediation tomorrow 😂🍿🍸
If this is real , I wished I could have her poker face when people are not being reasonable.
I lost a job of four years and became late with my rent. I skipped any meetings with the landlord. I just packed and left not waiting for an eviction. Later,I was able to rent another apartment in a prestigious area. At a higher security deposit, but still... All this is to scare you and make you pay. Very good actors.
this mediator lady is really calming lol
Lol
This could be a case where she could offer to pay the tenant to move into a shelter, cash for keys.
"I won't pay the rent but I want to have my cable connected" lol
"And I have to pay for my phone bill" LMFAOOOOO
I like this video, I do have some suggestions.
Sit both parties on the same side of the table. Have the parties find their own solutions, and have them feel like they came to the solution theirselves. Always caucus with the tenant first. Advocate for both parties. Do not put someone in the “hot seat”. Listen.
Most mediators are not Lawyers but, get lawyers fees. They take a 10 week course. I almost lost my mind when I found out. Be very careful. Anyone cane be a Mediator. PAY ATTENTION
Did he seriously say that he needs the cable since he's gonna be home more now?! Cable= GONE
I agree about the tv part that's a luxury not a necessity if you're in a bad position got to make sacrifices to do what you have to
"Everything you say doesn't leave this room." Lol ! 🤣🤣🤣
Entertaining--because it's so real. Genuine conflict, and not the kind of thing one sees on television. I don't know that it is "scripted:" seems too genuine. And maybe both gave permission to put it on KZclip...after the fact.
Why is this so entertaining!??!
Because no landlord would do this. They just file an eviction and sue your ass.
Really helpful..Thank you for uploading
It just shows how the house market destroys people’s minds ! He’s a sir without job she is a business person ... Government knows that house is a big issue !
She was nice enough to stopped the double asking for the late fees where not unreasonable
The problem is, after he sells the jewelry he still won't have a job and he will be right back in the same situation.
Great educational video. Wrong dispute material. Never heard a landlord mediate with a delinquent tenant. They simply evict them and sue for any unpaid rent and that’s that.
Exactly. He's arguing & hasn't got a leg to stand on legally!
Someone should help him find a place in senior housing. Maybe something subsidized. He can't just live there, and not pay rent.
@🌟 Lady Justnope. They had decades to prepare. They can go to family
Senior living is quite expensive more than rent
He cant live anywhere and not pay rent, though. Senior living places cost money too.
Yes our senior citizens need help. Take it out of my taxes
Thank you for this ADR vidéo. I am one of the experts on Alternative Dispute Resolution.
they both are so good i wish i saw before i have paid the rent for this old guy very sad
Wow I lived in Green Bay, Wisconsin for 3 years and I had NO idea that this place existed. Damn I miss living in Green Bay on Velp Avenue.
Good for her (the landlady)! I'm 20 and am going through a similar situation (I am owed).
me too, as a young student, I'm in a similar situation as you
You'll be paid
Is he crazy?? He's grappling over $100 of late fees....as if he's not late?
As a tenant rent is essential to be paid. Make payment arrangements BEFORE you get into difficulty. I can see both sides. The tenant is not being reasonable to be honest. You can't expect to stay for free and then complain when the Landlord gets upset about wanting their money. You go without cable TV and use pre-pay phone service. It can be done.
hey there,
will you help me to solving this situation
Its not real
This is positional mediation.
Agents most the times do not repair anything that was damaged before new tenants move in
This is confidential.
Broadcasts it to entire world.
I was a bit nervous but all set to mediate my fist "case". When each party arrived, the first thing each one did is roll out a mat then sit on it cross-legged; Turns out they thought this was to be a meditation session.... HAHA, I know, stupid joke- Seriously, this video was great!
I imagine this is staged or maybe some kind of training video.
this is role play for sure
"Just so you both know, everything that's said in this room is confidential..."
LMAOJKYOUTUBINIT
its a fake trial
Interesting informative video

Yes everything said in here is confidential except for the millions of KZcliprs
If I was an evaluative mediator I would make this recommendation in the caucus
Even if the landlord gets an eviction on the tenant, he still owes the landlord right?
😂 😂 😂 😂 this got to be a mock interview
Good to see a hard core landlord.

She’s irresponsible for purchasing a property she can’t afford and he should be vindictive in return and let her go in a downfall
Chatise Smith yes ,finally but not before leaving mice in my house they had babies , let’s not forget the voodoo
This guy is funny.

This definitely is not a meditation this is a shakedown. The "non partisan" mediator is definitely putting the screws to this poor guy.
It's fake/ a training video.
I thought the man was the landlord at first.🤣
Why do people think it's okay to not pay their rent? Would it be okay if their boss kept their paycheck? I bet not. This is a landlord income
There's are resources out there that can help you when times get tough. Alot of people don't know about these resources. He should give money to the landlord out of each check. Shows your trying to show good faith.

Imagine having someone steal thousands of dollars from you every single month and expecting you to be cool with it because they don't have a job. How about when I lose my job I hit you up for a thousand each month?
Mediator : The caucus is private
Mediator - Also puts it on the *KZclip*
I was almost laughing when he said he had no place to go ! In the town I live in homeless people are put up in hotels and motels within 24 hours until they get into apartments . It's called rapid rehousing .
@Heidi Robinson Springfield Mo.
Randy Scott:: what town is doing this to help their residents?
"A vacancy is far better than a bad tenant."
Sounds good!👍🏽
Damn, the comments are extra stupid here. This is a training video, children. Read the description. Learn how to internet. Cheers.
Landlord- "I want to get that money! I'm not a charity. He deserves to have a eviction on his record." And on and on.
What a vicious, money hungry, vindictive woman.
a vindictive money hungry money woman who is hungry for the money he totally owes her while she is literally paying for a roof over his head
This looks like a demonstration... not an actual mediation session since this being public and not confidential... is a total giveaway.
That and when she called her back in the room she was already in the room
Jon Frost the
Landlord is too lenient - Landlord has a mortgage payment, and other fees, which Landlord is not allowed to skip payments - Tenant should and must be responsible with due dates and abide to the contract- Tenant already breached contract
Landlord shouldn’t go into debt for a mortgage she can’t afford.
I like her sweater!! Entertaining & sort of informative video!! 🗽❇🌄🎋💄💃😇😎🐘🚢👑👕🎫
Two points the landlord did not ask:
a) I want a professional appraiser to verify the value of mentioned jewelry.
He's not old enough for SS. It happens all the time 😰
hello sir ,
will you help me to solving some related with this video
hello sir ,

Wor Lock the sheriff will remove you for a small fee
I enjoyed watching that.
Criminal act 1: it's not confidential if I'm watching.
When Laura Dern used to be a landlord...
omg the logic “no one’s gonna move in the winter so she’s gonna have an vacant apartment anyways so i might as well live for free”. well dude, people don’t only move when it’s convenient…. for example when you get kicked out and have to find another place you will be moving in somewhere in the winter…. doesn’t he get social security or have family or anything
Lol it is on social media but private 😂
"everything in here is confidential" watches on youtube >_>
The problem with mediation it's legally binding no appeals
Even though they’re actors, I’d be damned if my landlord is gonna increase the amount I owe by two/three-fold bc I’d just laugh in her face. Nowhere is that acceptable for being 5 weeks late on rent like wtf 👋🏼😂
Depends on what your lease says.
The tactics of renting houses and show the houses to 20 candidates at same time and most the times tenant still there with furniture so people cannot see the state of house .
atleast this tenant is not as worse as a professional tenant
I see why he in this situation. He worried about the wrong thing and is a know it all
The reason we are here is you owe me money lol
No pay no stay
This isnt even be a discussion. It’s not the owners problem if he can’t pay. Evict and move on. Dumb of her to entertain the idea letting him continue.
Hes got cable so he can still watch the NFL channel lol
pay the rent...
Only shared on you tube. Confidential lol
I bet he does eventually gets evicted and owes owes the $3000
..who pays the mediation fees?
The party that brought case to mediation, sometimes when court judge sends cases to mediation, he can decide if fees should be split or even waived. Some courts request that mediator work at least one case free of charge.
